Terms of Service

These Terms of Service ("Terms") govern your use of Leakless (leaklesshq.com and the Leakless service), operated by ARKFLOW, INC., 131 Continental Dr Ste 305, Newark, DE 19713 ("ArkFlow", "we", "us"). By joining the waitlist, creating an account or using the service, you agree to these Terms. If you use Leakless for a business, you accept these Terms on its behalf.

The service

Leakless is speed-to-lead software for home-service businesses: missed-call text-back, lead replies, an AI SMS assistant that helps book jobs, owner alerts, a weekly Leak Report and an AI-visibility check. Leakless is currently pre-launch; early access is opening soon. Features may change before and after launch.

Accounts

You must provide accurate information, keep your login secure, and be at least 18 and authorized to bind your business. You are responsible for activity under your account.

Trial, billing and refunds

  • Paid plans are billed monthly in advance, month-to-month, at the price shown on our pricing page when you subscribe.
  • New accounts get a 14-day free trial, card required. The trial starts when customer texting goes live for your account (after carrier texting registration is approved), not at signup. The trial runs on whichever plan you pick.
  • Full refund within 7 days of paying, no questions asked. Email support@arkflow.io within 7 days of a charge.
  • You can cancel anytime from your billing page. Cancellation takes effect at the end of the current billing period, and you keep access until then.
  • If a payment fails, we may suspend texting after a grace period. STOP and HELP handling continues.
  • Prices exclude taxes, which you are responsible for where applicable. We will give notice before changing prices for your plan.

Acceptable use and messaging compliance

You agree not to use Leakless to send spam or unsolicited messages, or to violate any law or carrier rule. In particular, you are responsible for:

  • complying with the Telephone Consumer Protection Act (TCPA), state telemarketing and texting laws, CAN-SPAM, and carrier and industry requirements (including A2P 10DLC registration rules);
  • obtaining and keeping records of all consents required to contact your customers and leads, including prior express written consent for marketing texts;
  • honoring opt-outs and not re-adding contacts who opted out;
  • the accuracy of the information, prices and content you provide for the AI assistant and your messages.

You may not send unlawful, deceptive, harassing or hateful content, use the service for debt collection or high-risk lending, attempt to break or overload the service, or resell it without our written permission. We may suspend or terminate accounts that violate these Terms or receive excessive complaints.

Your data

You own the data you put into Leakless. You give us permission to use it to provide and improve the service, as described in our Privacy Policy. You are responsible for having the right to provide it to us.

Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not guarantee that messages will be delivered, that the service will be uninterrupted or error-free, or any particular number of leads, bookings or revenue. AI-generated replies and estimates may be inaccurate; you are responsible for reviewing how the assistant is configured.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKFLOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Indemnity

You will defend and indemnify ArkFlow against claims arising from your messages, your contacts' consent, or your violation of these Terms or applicable law.

Termination

You may stop using the service at any time. We may suspend or end access for breach of these Terms, non-payment, or to comply with law or carrier requirements.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction, and you consent to their jurisdiction.

Changes

We may update these Terms. We will post the new version here and update the date above; material changes will be notified in advance where appropriate. Continued use after changes take effect means you accept them.
